These Terms of Service govern your use of the KRAFFTD website and our professional digital services.
By accessing or using the KRAFFTD website (krafftd.com) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, clients, and others who access or use our services.
KRAFFTD provides professional digital services including, but not limited to, web design, website development, web application development, and branding and identity design. The specific scope, deliverables, timelines, and fees for each project are defined in a separate project agreement or proposal agreed upon by both parties prior to the commencement of work.
All projects are governed by a separate written agreement or proposal that outlines the scope of work, payment schedule, and deliverables. Standard payment terms require a deposit before work commences, with the remaining balance due upon project completion or as specified in the project agreement. Failure to make timely payments may result in the suspension of work or the withholding of final deliverables until payment is received in full.
Upon receipt of full payment, KRAFFTD transfers ownership of the final deliverables (such as website files and design assets) to the client as specified in the project agreement. KRAFFTD retains ownership of all preliminary concepts, drafts, and unused designs. KRAFFTD reserves the right to display completed work in its portfolio and marketing materials unless the client explicitly requests confidentiality in writing.
The client agrees to provide accurate and complete information, content, and materials necessary for the completion of the project in a timely manner. Delays caused by late client feedback, approvals, or content delivery may affect project timelines. The client is responsible for ensuring that any materials provided to KRAFFTD (including images, text, and logos) do not infringe upon the intellectual property rights of any third party.
The number of revisions included in a project is defined in the project agreement. Additional revisions or changes to the agreed scope of work may be subject to additional fees. Significant changes to the project scope after work has commenced may require a revised agreement.
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. KRAFFTD will not disclose client business information, strategies, or data to third parties without prior written consent, except as required by law.
KRAFFTD's total liability to the client for any claims arising from or related to a project shall not exceed the total fees paid by the client for that specific project. KRAFFTD is not liable for any indirect, incidental, special, or consequential damages, including lost profits or business interruption, even if advised of the possibility of such damages. KRAFFTD is not responsible for third-party services, platforms, or integrations used in a project.
Either party may terminate a project agreement with written notice if the other party materially breaches the agreement and fails to cure such breach within 14 days of receiving written notice. Upon termination, the client shall pay for all work completed up to the termination date. KRAFFTD shall deliver all completed work product upon receipt of final payment.
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms or from the services provided shall be subject to the exclusive jurisdiction of the courts of the Philippines.
KRAFFTD reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
